Reply comments on a digital radio power increase 1/12/09
Media Access Project submits these reply comments on behalf of Prometheus Radio Project, National Federation of Community Broadcasters, and New America Foundation (“Prometheus, et al.”) in response to the initial comments filed pursuant to the Commission’s Public Notice seeking comment on a proposed across-the-board digital power increase. See Comment Sought on Joint Parties Request for FM Digital Power Increase and Associated Technical Studies, MMDocket No. 99-325 (Nov. 24, 2008). Based on initial comments filed, it is evident such an increase would be detrimental to current analog service and therefore would not be in the public interest. Consequently, there is almost no support for the across-the-board increase sought by the Joint Parties. It is also evident that a ten fold increase in power would trigger the statutory auction requirement. Finally, further testing must be conducted before the Commission can consider any type of increase. Thus, the Commission must deny the Joint Parties’ request for a power increase.
